Terms of Service

1. Introduction and Acceptance

These Terms of Service (“Terms”) govern your access to and use of the Mealwise recipe management platform (“Service”), operated by Tenth Bridge Consulting Ltd, a company registered in England and Wales (“we”, “us”, “our”).

By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

We may update these Terms from time to time. If we make material changes, we will notify you via email or an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after that notice period constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may close your account at any time.

2. Eligibility

You must be at least 16 years old to create an account and use the Service. By registering, you confirm that you meet this age requirement.

If you are between 16 and 18, you confirm that you have the consent of a parent or legal guardian to use the Service and that they have read and agreed to these Terms on your behalf.

3. Personal, Non-Commercial Use Only

The Service is provided for your personal, non-commercial use only. You may not use the Service, or any content accessed through it, for commercial purposes including but not limited to:

  • Selling, licensing, or commercially distributing recipes, meal plans, or other content generated by or stored in the Service.
  • Using the Service to operate a food business, catering service, meal-prep company, or similar commercial enterprise.
  • Scraping, extracting, or systematically downloading content for republication or resale.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used for commercial purposes.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

  • Provide accurate and complete information when creating your account.
  • Keep your account information up to date.
  • Notify us immediately of any unauthorised use of your account.
  • Not share your account credentials with others.

We are not liable for any loss or damage arising from your failure to maintain the security of your account.

5. User Content and Intellectual Property

You retain full ownership of all recipes, photographs, notes, adaptations, and other content you create or upload to the Service (“Your Content”).

By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, display, process, and transmit Your Content solely for the purpose of providing and improving the Service. This licence terminates when you delete Your Content or close your account.

You represent and warrant that you have all necessary rights to upload Your Content, and that it does not infringe the intellectual property or other rights of any third party.

All intellectual property in the Service itself (including software, design, trademarks, and branding) remains our property or that of our licensors.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Upload content that infringes on the intellectual property rights of others.
  • Attempt to gain unauthorised access to other users' accounts, data, or any part of the Service's infrastructure.
  • Use automated tools, bots, scrapers, or crawlers to extract data from the Service.
  • Interfere with, disrupt, or place an undue burden on the Service or its infrastructure.
  • Upload malicious content, viruses, or harmful code.
  • Impersonate another person or misrepresent your affiliation with any person or entity.
  • Use the Service to send spam, unsolicited messages, or marketing materials.

7. AI-Powered Features — Important Disclaimers

Mealwise includes AI-powered features such as recipe scanning (OCR), nutritional analysis, allergen detection, dietary labelling, flavour profiling, cost estimation, meal building, leftover guidance, and Chef Chat. These features are powered by third-party AI services (currently Anthropic Claude).

Food Safety and Allergen Warning

AI-generated dietary analysis, allergen detection, and nutritional information are provided as general guidance only and may be inaccurate, incomplete, or out of date. You must not rely on this information for health, dietary, or allergy-related decisions.

If you have food allergies, intolerances, or medical dietary requirements, you must always:

  • Check all ingredient labels and packaging yourself.
  • Consult with a qualified healthcare professional, dietitian, or allergist.
  • Contact food manufacturers directly if you are uncertain about ingredients.
  • Exercise your own judgement before consuming any food.

We accept no responsibility or liability for any adverse reactions, illness, injury, or death resulting from reliance on AI-generated information provided by the Service.

More generally, all AI-generated content (including recipe suggestions, cooking recommendations, ingredient substitutions, cost estimates, and storage advice) is provided for informational purposes only. It should not be treated as professional, medical, nutritional, or financial advice. We do not guarantee the accuracy, completeness, safety, or suitability of any AI-generated content.

By using AI features, you acknowledge that you use them at your own risk and accept full responsibility for any decisions you make based on AI-generated content.

8. Subscriptions and Payments

Mealwise offers free and paid subscription tiers. Paid subscriptions are processed through Stripe and billed on a recurring basis (monthly or annually, as selected at the time of purchase).

  • Auto-renewal: paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
  • Cancellation: you may cancel your subscription at any time from your account settings. Upon cancellation, you retain access to paid features until the end of your current billing period.
  • Cooling-off period: if you are a consumer in the UK or EU, you have a statutory 14-day cooling-off period from the date of purchase. If you begin using the paid features during this period, you acknowledge that you may lose your right to cancel, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
  • Refunds: outside the statutory cooling-off period, refunds are at our reasonable discretion. We will always comply with applicable consumer protection laws.
  • Price changes: we reserve the right to change subscription prices with at least 30 days' notice. Price changes will apply from your next billing period after the notice period.
  • Downgrade: if your subscription ends or you downgrade to a free tier, you retain access to your stored recipes and data, but may lose access to premium features. No data is deleted.

We do not store your payment card details. All payment processing is handled securely by Stripe in accordance with PCI DSS standards.

9. Family Sharing

The family sharing feature allows you to share recipes, meal plans, and collections with members of your family group. You are responsible for managing access to your family group and ensuring that all members comply with these Terms.

Content shared within a family group is visible to all members. If a member leaves or is removed from a family group, their access to shared content from other members is revoked, but their own contributed content remains theirs.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
  • Our total aggregate liability for any claim arising from or relating to the Service shall not exceed the greater of (a) the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) £50.
  • Without limiting the generality of the above, we are not liable for any loss, damage, illness, injury, or death arising from your reliance on AI-generated content, including allergen detection, dietary analysis, nutritional estimates, cooking instructions, storage advice, or any other information provided by the Service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law (including under the Consumer Rights Act 2015).

11. Indemnification

You agree to indemnify, defend, and hold harmless Tenth Bridge Consulting Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to your use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

12. Service Availability and Modifications

We strive to keep the Service available at all times but do not guarantee uninterrupted, timely, secure, or error-free access. The Service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications.

We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to provide advance notice of significant changes that affect your use of the Service.

13. Termination

By you: you may close your account at any time using the account deletion feature in Settings. Before deleting your account, you may export your data using the data export feature.

By us: we may suspend or terminate your access to the Service if you materially breach these Terms, with notice where practicable. In cases of serious or repeated violations, we may terminate immediately without notice.

Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy.

14. Dispute Resolution

We hope to resolve any disputes informally. If you have a concern, please contact us first at legal@mealwise.guru. We will do our best to resolve the matter within 30 days.

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, nothing in this clause affects your statutory rights, including your right to bring proceedings in the courts of the country where you reside.

16. Severability

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding your use of the Service and supersede all prior agreements and understandings.
